The Commission adopted in March 2023 a list of recommendations to ensure greater deployment of energy storage, accompanied by a staff working document, providing an outlook of the EU’s current regulatory, market, and financing framework for storage and identifies barriers, opportunities and best practices for its development and deployment.

How many states have energy storage policies?

Around 15 states have adopted some form of energy storage policy, including procurement targets, regulatory adaption, demonstration programs, financial incentives, and/or consumer protections. Several states have also required that utility resource plans include energy storage.

What are the ITC proposed regulations (reg-132569-17)?

ITC Proposed Regulations (REG-132569-17): The guidance retains the Code’s broad approach to defining new ITC-eligible energy storage property but also includes a nonexclusive list of qualifying technologies. The guidance confirms that a separate PTC-generating project may be co-located with a separate ITC-eligible project.

DEFRA is planning to bring battery energy storage systems (BESS) into the environmental permitting regime. However, some operators may be unaware that they may be subject to it already, putting themselves in potential legal jeopardy.

Can a PTC-electing energy production facility be paired with an energy storage facility?

Principally, this means that a PTC-electing eligible energy production facility (such as a solar facility now eligible to elect to use the PTC after the IRA) may be paired with an energy storage facility without impacting the ability to claim an ITC for the storage facility.
