The new rule also requires economic operators to create an EU declaration of conformity for batteries that complies with the requirements of the regulation. If a battery is subject to more than one regulation in the EU, one declaration can be provided to cover all applicable regulations.

The Batteries Regulation is a new regulation that sets requirements for batteries and waste batteries placed in the EU market. It covers all types of batteries unless an exemption applies. The EU has implemented a sweeping new regulation that imposes significant obligations on manufacturers, importers, and distributors of batteries in the European market. The EU battery regulation was adopted June 14, 2023, and it replaces the current batteries legislation, EU Directive 2006/66/EC Battery Directive.
Some batteries manufactured primarily for other markets outside the EU may still contain mercury and cadmium above the set limits. That said, Sony, Samsung, and other major battery brands generally ensure that all their products are compliant with EU regulations.
You can find the relevant provisions in Article 96. The Batteries Directive will be repealed with effect on 18 August 2025. Article 95 lists provisions for this repeal, which includes information on articles that will keep applying for a longer time.
